  1. NO NO NO NO
  2. I did some quick googling and found a couple of resources on food establishment laws in Texas : http://www.google.com/search?sourceid=navclient&aq=t&ie=UTF-8&rls=GGLD,GGLD:2004-52,GGLD:en&q=austin+texas+food+business+laws http://www.dshs.state.tx.us/foodestablishments/ http://austin.about.com/cs/smallbusiness/a/homezoning.htm Depending on where you live, the cost of setting up such a business may not make it feasible to operate as a home based business. Then again, looking at things in a positive light, everyone had to start somewhere right? Perhaps starting small may be a better way to go. You might want to consider selling at : - flea markets - supplying to your local delis - supplying to your local grocers - county fairs Get a feel for the business. My first thought is that unless you have a slew of really unique recipes for candy, this might be a really tough niche to go into with just one type of candy. There is so much competition. You might also want to consider setting up a snack store where you sell a variety of products and feature your own line of candy. If orders for your candy picks up, then you can explore actual plans to set up a commercial kitchen to produce your candy. If you find that your candy doesn't take the world by storm, you still have your snack business which will open up lots of opportunities for a creative mind like yours, yes?
